ORDER:
In the G.O. first read above, orders were issued, inter-alia as follows:-
The Government have decided to provide for recruitment in each Category/Group of posts viz. Group A, Group B, Group C, and Group D posts where representation of Scheduled Caste/Scheduled Tribes is less than 19%. The direct recruitment in each Group will be at the lowest level of post in that Group viz. Group A Group B Group C , Group D.
i) Accordingly, the Government direct that the adequacy of representation of SC/STs in each Category/ Group of posts in all Government Departments State Government undertakings/ Public Sector Undertakings and Institutions receiving Government aid shall be assessed and persons belonging to SC/STs shall be appointed by direct recruitment where the representation of SCs/STs is less than 19%. Such direct recruitment shall beat the lowest level in the Category viz. Group A Group B, Group C Group D.
.2. ii) In order to achieve the objective stated in the above paragraph it has been ordered that appropriate rules be made wherever necessary in the service rules to incorporate the provisions for direct recruitment.
2. In the G.O. second read above, orders were issued to fill up back-log vacancies that were identified and that arose from 1.4.1989 in each Department at the entry level within a period of five years.
3. In the Government letter third read above all the Secretaries to Government were informed that as it was decided to fill up back-log vacancies at the entry level posts in each department that arose from 1.4.1989 within a period of five years vide G.O. Ms. No. 33, Adi Dravidar and Tribal Welfare Department, Dated 8.5.2000 covering all the reserved Communities including SC/STs, no further action need to be pursued with regard to G.O. Ms. No. 44, Adi Dravidar and Tribal Welfare Department, Dated 20.5.1998 by the Government Departments and Public Sector Undertakings.
4. The Government have now examined the matter in detail in the light of views expressed by certain sections of society for restoration of orders issued in G.O. (Ms,) No. 44, Adi Dravidar and Tribal Welfare Department, Dated 20.5.98. The Government have decided to restore the orders issued in G.O.Ms. No.44, Adi Dravidar and Tribal Welfare Department, Dated 20.5.1998, in so far as it relates to providing for direct recruitment in each category / Group of posts in the lowest level of post in that Group viz., Group A, Group B, Group C, and Group D.
5.The Secretaries to Government, the Heads of Departments and Chief Executives of Public Sector Undertakings are requested to take necessary further action on the orders issued in paragraph 2,3 and 4 of G.O.(Ms) No. 44, Adi Dravidar and Tribal Department, Dated 20.5.98.
6. The Government further direct as follows:-
i) The SC/ST short-fall vacancies shall be assessed without fixing cut- off date. A format for assessing short-fall vacancies is annexed to this G.O.
ii) All State Government Departments/ Public Sector Undertakings and Institutions receiving Government aid may start the exercise of making necessary provisions in the service/recruitment rules wherever short-fall/ backlog vacancies are noticed. iii) Each Department should have its own Committee headed by the Head of the Department to review all the rules and the representations of SCs/STs as on date and suggest amendments to the rules wherever necessary to incorporate provisions for direct recruitment without delay. iv) A High Level Committee headed by Honble Minister for Adi Dravidar and Tribal Welfare with Secretary (AD & TW) as Convenor and Secretaries, Personnel and Administrative Reforms, Law and the Secretary of the concerned Department shall be formed. v) The above Committee shall be entrusted with the task of reviewing all the posts in each Department and suggest suitable amendments /criterion in the service, Rules, for filling of backlog/ shortfall vacancies. vi) Feasibility of promoting the SCs/STs from the feeder category exclusively for filling up of shortfall /backlog vacancies (Subject to the legal implication) shall be considered during the departmental review. vii) Once the High Level Committee headed by the Minister for Adi Dravidar and Tribal Welfare has completed the exercise in respect of the Departments, the resultant plan of action in batches, should be placed before the Counsil of Ministers for clearance. viii) After getting the clearance of the Council of Ministers the decision of the High Level Committee, should be implemented by the departments concerned, immediately by taking necessary further action for notifying the short-fall / back-log vacancies to the concerned recruiting /appointing authorities viz., Tamil Nadu Public Service Commission, Teachers Recruitment Board , Uniformed Recruitment Board, etc. ix) The Honble Chief Minister shall be informed about the progress made in each department through Chief Secretary and Minister of concerned department and the Minister, Adi Dravidar and Tribal Welfare, quarterly.
