ORDER:

In the G.O first read above, consolidated policy guidelines were issued, specifying the terms and conditions for the grant of centralised permission for the use of the Public right of way by any Private or Public Sector applicant that proposes to lay Optic Fibre Cable (OFC) in Tamil Nadu.

2. In the G.O. second read above, Government accorded its 'in principle' approval to the proposal of M/S  BHARTI TELENET LTD., for using the Public right of way in Tamil Nadu starting with Chennai, in terms of the  guidelines issued in the G.O. first read above.

3. Subsequently Bharti Broadband Networks Limited and Bharti Telesonic Limited were merged with M/s Bharti Telenet Limited and the name of the said company namely “M/s Bharti  Telenet Limited”  has been changed to 'M/s BHARTI INFOTEL LIMITED' and a fresh certificate of incorporation has been issued by the Registrar of Companies;  NCT of Delhi and Haryana.

4. In the G.O third read above orders were issued in supersession of orders issued in the G.O second read above, according in principle approval to the proposal of M/s Bharti Infotel Limited for using the Right of Way  to lay Optic Fibre Cables for using the Public right of way to lay of Optic Fibre Cables to provide basic Telephone services in Tamil Nadu starting with Chennai in terms of the guidelines issued in the G.O. first read above.

5. Subsequently as a result of merging Bharti Infotel Limited ( BIL) and Bharti Cellular Limited (BCL) with its 100 %  holding Company M/s Bharti Tele-Ventures Limited  (BTVL)  vide Hon’ble High Court order dated 21.5.2005 the name of the  said  company  namely  M/s  Bharti   Infotel    Limited   had   been   changed   to  'BHARTI TELE-VENTURES LIMITED' with effect from 9.6.2005 and a fresh certificate of incorporation has been issued by the Registrar of Companies;  NCT of Delhi and Haryana.

6. In the G.O fourth read above orders were issued accordingly 'in principle' approval to the proposal of the Bharti Tele-Ventures Limited for using the Public right of way to lay Optic Fibre Cables to provide basic Telephone services in Tamil Nadu starting with Chennai in terms of the guidelines issued in the G.O. first read above.

7. In his letter fifth read above, the Chief Technology Officer, M/s Bharti Tele-Ventures Limited has stated that Bharti Tele-venture Limited ( BTVL) and Bharti Cellular Limited (BCL) have been merged with its 100 %  holding Company BHARTI AIRTEL LIMITED  (BAL) vide certificate of Incorporation dated 24.4.2006. Hence M/s Bharti Tele-Ventures Limited have  requested the Government to issue requisite  amendment to the G.O. Ms. No.8 dated 14.7.2005 of Information Technology Department.

8. The proposal of the Chief Technology Officer, Bharti Airtel Limited has been carefully examined by Government.  In supersession  of the orders issued in the G.O. fourth read above, the Government hereby accord its 'in principle' approval to the proposal of the Bharti Airtel Limited for using the Public right of way to lay Optic Fibre Cables to provide basic Telephone services in Tamil Nadu starting with Chennai in terms of the guidelines issued in the G.O. first read above.  The Government  directs the company to abide by the terms and conditions  specified in the G.O. first read above and the additional terms and conditions  if any that may be imposed, in Public interest based on local site conditions by Highways Department and the respective local bodies in public interest depending on local conditions.

9. Bharti Airtel Limited., is directed to initiate further action and keep the Government in Information Technology, Highways, Municipal Administration and Water Supply Departments, Corporation of Chennai and the Commissioner of Police Chennai informed of the progress in implementation of their project through detailed fortnightly reports.
