Information Technology - Procedure for grant of Stamp Duty concessions to units in the Private Sector Information Technology parks - clarification - Issued.

ORDER:

In the Government Order first read above, orders were issued for an exclusive Information Technology Policy for Tamil Nadu. As per the said Information Technology Policy units in Private Information Technology Parks (ITPs) will be entitled for exemption from Stamp Duty and registration charges at the time of allotment of sites/built up space as in the case of units in Electronics Corporation of Tamil Nadu Limited (ELCOT) / State Industries Promotion Corporation of Tamil Nadu Limited (SIPCOT) Industrial Estates. Further, the Government will also encourage software development outside the parks by giving stand-alone units the same incentives as the units in the ITPs / Software Technology Parks (STPs).

2. In the Government Order second read above, the Information Technology Policy was modified to the effect that the developers in private STPs/ITPs have to register the property first on payment of Stamp duty at the prescribed rates and then claim reimbursement from ELCOT . The reimbursement claims received through ELCOT will be scrutinised and recommended by a Committee, comprising of representatives from ELCOT, I.G. of Registration and Finance Department of the Government.

3. The said Committee, while scrutinising some claims under these guidelines, have sought an explicit definition of what constitute an ITP / STP.

4. Government , after careful consideration, direct that the following criteria be incorporatead at the end of para 4 under "New Initiatives" of the IT Policy issued in the G.O. first read above.

"To qualify as an ITP/STP under the policy ,

 

(a) the facility must have high band width global connectivity ,
(b) be fully occupied by software units,
( c) Atleast 50% of the total turn over of the units must be for exports
(d) ELCOT will be the certifying authority .
(e) In addition , for CMDA’s purposes, the plot area on which such faciltiy is located must be a minimum of 2000 square meters".

 

5. This order issues with the concurrence of Finance Department U.O.No. 2584/FS/P/2000 dated 11.8.2000.
