ORDER:
In the Government Order first read above, guidelines specifying the terms and conditions for the use of public right of way by any private or Public Sector licensees that proposed to lay Optic Fibre Cable along with National and State Highways and other roads in the State of Tamil Nadu, were issued. Permission for right of way has been provided to the licensed Private/ Public Sector Company for laying Optic Fibre Cable along the side of Government roads.
2. Reliance Infocom Private Limited has requested the Government to permit them to lay the Optic Fibre Cable inside various Government Offices and buildings.
- 3. The Government have considered the request and decided to permit all the Private/Public Sector licensees to lay their Optic Fibre Cable within the premises of offices/buildings occupied by the Government on a non exclusive basis subject to the following conditions:
- a) The Basic Telecom Operators licensed to operate voice/data/video any or all modes of communication networks shall be eligible for the laying of the cables within the premises of Government buildings and Government occupied buildings, subject to the terms and conditions of the order read above.
- b) The Licensed Basic Telecom Company will submit application enclosing the layout plan of the Optic Fibre Cable specifying the route, depth, facilities to be created over ground etc, for the approval of the respective occupants before commencement of the work.
- c) The Licensed Basic Telecom Company will reinstate at their cost, the premises used, to their original condition, on completion of all installation and related works.
- d) The Licensed Basic Telecom Company will bear the entire cost of ducts, cables and equipment as well as installation with in the premises on a non-exclusive basis.
4. The Authority to give permission to lay cables with in the Government owned /occupied buildings shall be vested with:-
- a) The Nodal officer or Custodian of the building who is incharge of maintenance and amenities in case of large Government Complexes and other Government Complexes.
- b) The Head of Departments shall be the Nodal Officer in respect of other Government Offices.
- c) In case of Secretariat, the Public Department will play the role of Custodian for the laying of cables within the Secretariat Campus.
- d) District Collectors may authorize to lay the Optic Fibre Cable Cables within the Collectorate and other Government owned/occupied premises in the Districts.
- e) In case of Government Offices located in private buildings the Head of Departments/the Nodal Officer will take the consent from the building owner before permitting the laying of cables.
- f) Subject to conformity of the terms of this order, the competent authority may issue permission within a period of 2 weeks from the date of application.
- g) In case the permission is not issued to the Licensed Basic Telecom Operator for the laying of Optical Fibre Cable within the premises of the Government buildings/Government occupied buildings within 2 weeks from the date of application to the competent authority under proper acknowledgement, the permission to lay the cables is deemed to have been issued. This provision relating to deemed permission shall come into effect prospectively.
5. The orders issues with the concurrence of Public Works /Highways and Municipal Administration and Water Supply departments.
